Food Delivery - Terms & Conditions
These Terms and Conditions ("Terms") constitute a legally binding agreement ("Agreement") between you and Dunnes Stores relating to our food delivery service (the Service”).
When these Terms mention "Dunnes Stores," "we," "us," or "our", it refers to the Dunnes Stores company. If you use our Service, we will refer to you using the terms "user", "visitor", "you", "your", "yours" in these Terms.
If you do not agree to these Terms, please do not use our Service. We may amend these terms and conditions from time to time by updating them on our website. If you do not wish to accept the amended Terms, you should not continue to use our Service. If you do continue to use our Service, you will be bound by the amended Terms.
1. Terms of sale
By placing an order with us by telephone, you are offering to purchase the product(s) on and subject to the following Terms. Your offer will remain open until it is accepted by us.
The Service is only available in respect of a minimum order amount of at least EUR20.
In order to contract with us you must be over 18 years of age, resident and with a delivery address within our delivery zones in the Republic of Ireland and possess a valid credit or debit card issued by a bank acceptable to us. When placing an order, you warrant and undertake that all details you provide to us are true, accurate, current and complete in all respects, that you are an authorised user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the products.
2. How our contract is formed
When you place an order by telephone, we will confirm, by phone, receipt of the order. We may accept your offer by making a delivery to you. The contract for the sale of the product will be formed when our driver arrives at the delivery address. All orders are subject to availability and confirmation of the total order price.
Whilst we try and ensure that all details, descriptions and prices are accurate, errors may occur. We reserve the right to refuse to fulfil any orders that you may place based on information that may contain errors or inaccuracies, including, without limitation, errors, inaccuracies or out-of-date information regarding pricing, payment terms, or return policies.
The price you will be charged for a product you have ordered will be the price at which it is on sale in store at the time your order is confirmed by telephone. Because the prices of products may change frequently, this may not be the price at which the product was displayed in our promotional material which may have an expiry date.
The prices advertised include VAT but exclude delivery costs at the rate of EUR3.00 for all orders under EUR50, which will be added to the total amount. Orders of €50 and over currently qualify for free delivery, however we reserve the right to amend or cancel this offer at any time.
4. Payment and VALUEclub
You may pay using only Visa, MasterCard credit/debit cards and Maestro cards. All payments are subject to validation checks and authorisation by your card issuer. If your card issuer fails to authorise the payment to us, we will not be liable for any delay or non-delivery and may not be able to form a contract with you or we will not be able to proceed with your order. Dunnes Stores must receive full payment for the order at the time the order is processed and before the product is dispatched.
VALUEclub points will be earned when you purchase for delivery. VALUEclub details should be provided when submitting your order. VALUEclub points cannot be added to your account after the order has been accepted.
Valid VALUEclub Vouchers and Shop and Save Vouchers can be redeemed as part of your purchase and details should be provided when submitting your order. Vouchers cannot be accepted after the order has been accepted.
5. Stock availability
All orders for products are subject to availability including in the event of supply difficulties or because products are no longer in stock. If a product you have ordered is unavailable altogether or if a product you have ordered is not available in the quantity you have ordered, we will contact you and will process a refund on your card.
6. Refusal of order/withdrawal of products
Dunnes Stores reserves the right to withdraw any products from its offering at any time. We may decline any order or decline to sell any product you have ordered without giving any reason and without any liability to you. Without restricting this, we may decline to sell products where they are not available or where we believe that the order has not been placed by a consumer.
Whilst we will use our reasonable endeavours to authorise payments submitted to us, there may be exceptional circumstances which mean that we may need to refuse to process or accept an order after we have received it, which we reserve the right to do at any time, at our sole discretion.
Dunnes Stores will not be liable to you or any other third party by reason of our withdrawing any product from our offering or for declining or refusing to process or accept an order after we have received it.
7. Your order delivery
Subject to availability (see Clause 5 above), we will endeavour to fulfil your order within a reasonable time unless there are exceptional circumstances. Dispatch times may vary and delivery times are not guaranteed and may be subject to delays arising, including in the case of force majeure, for which we will not be responsible. If for any reason we cannot meet the delivery time, you will be kept informed and offered a choice of either continuing with the extended delivery time or cancellation with a full refund.
For the purpose of these Terms, “delivery” or “delivered” shall be deemed to have occurred upon delivery of the product (s) at the address specified by you when you completed your order.
One delivery charge applies for your order, regardless of how many products you purchase.
To comply with social distancing measures, we will deliver your order to the main entrance of the delivery address, where it is safe to do so, or otherwise as near as practicable to that entrance.
Products will only be delivered to an adult aged 18 years or over. If proof is not available and there is no-one of that age at the address when delivery is being made, the products may be retained by the driver. If we attempt to deliver your order to the delivery address as arranged with you but there is nobody at the delivery address to accept your order, the products may be retained by the driver. In each case, you will need to contact our Customer Service Centre to re-arrange delivery (see below for contact details).
8. Risk and title
Any products ordered will be at your risk from the time of delivery. Ownership of the products will only pass to you when we receive full payment of all sums due in respect of the products, including delivery charges, or upon delivery, whichever is later.
9. Returns, cancellations and refunds
Please see Clause 13 of our online Terms and Conditions of Sale for details of our general refund policy and exclusions.
You may hand any faulty or damaged products back to the driver at the time of delivery for a refund or return to our store (with proof of purchase) for a refund or exchange. For perishable products, we ask you do this no later than 7 days after the date of delivery.
Please see Clause 7 of our online Terms and Conditions of Sale in relation to Right of Withdrawal/Cooling Off which does not include perishable products.
Refunds are processed to the original form of payment used when paying for the order. If products received as a 'gift' (recipient is not the purchaser) are returned for refund, the refund will be processed back to the original form of payment used when ordering. If you paid by Valueclub voucher, any associated refund will be applied to a Dunnes Stores gift card.
We warrant to you that any products purchased from us are of satisfactory quality and reasonably fit for all of the purposes for which products of the kind are commonly supplied. To the fullest extent permissible pursuant to law, but without excluding anything that may not lawfully be excluded in the case of consumers, we disclaim all other warranties of any kind, whether express or implied, in relation to the products. All product descriptions, information and materials are provided “as is” and without warranties express, implied or otherwise howsoever arising.
Our liability in connection with any product purchased is strictly limited to the purchase price of that product. Nothing in this Clause will affect your statutory rights.

These Terms shall be governed by and construed in accordance with the laws of the Republic of Ireland and all disputes will be referred to the exclusive jurisdiction of the Irish Courts.
If you breach these Terms and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these Terms.
We shall not be liable for any breach of these terms and conditions caused by circumstances beyond our control.
If any of these Terms or any provisions of a contract are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.
In no circumstances will our liability to you in connection with any order exceed the total price charged for the relevant products.
You may not assign, sub-license or otherwise transfer any of your rights under these Terms.
