1. PRIZE: WIN 1 PAIR OF TICKETS TO THE XFACTOR LIVE FINAL PLUS FLIGHTS AND ACCOMMODATIONTHE PARTIES
    1. This is a promotion offered by Dunnes Stores having its place of business at Dunnes Stores, 46-50 South Great George's Street Dublin 2, Ireland and company number 317228 (the Promoter). It is being offered in conjunction with Reckitt Benckiser Ireland Limited of 7 Riverwalk Citywest Business Campus Dublin 24 and company number 53584 (the Supplier).
    2. Zinmobi limited having its place of business at Tom Crean Business Centre, Kerry technology park, Tralee, Co Kerry and company number 484369, as a provider of mobile messaging service to Dunnes Stores. Specifically, Dunnes stores holds a dedicated short code through Zinmobi. Zinmobi manage the “Text To Win” competition entry mechanic on behalf of Dunnes Stores, ZinMobi will carry out the prize draw and pass the winners details on to Mesh Marketing for prize fulfilment. Reference to the Promoter in these terms and conditions includes its agents and contractors, including Zinmobi.
    3. Mesh Marketing Limited having its place of business at 12-16 Laystall Street, London EC1R 4PF, England and company number 05051252, who will manage the prize fulfilment of this prize draw.
  2. HOW TO ENTER
    1. The prize draw will run from 00:01 BST on 7 September 2015 to 23:59 GMT on 9 November 2015 (the "Closing Time") inclusive.
    2. All prize draw entries must be received by the Promoter no later than the Closing Time. All prize draw entries received after the Closing Time will be automatically disqualified.
    3. No purchase necessary.
    4. To enter the prize draw, simply Free Text the code “TICKETS” followed by your email address to 50555.
    5. All SMS entrants into the promotion should receive a message via SMS within 5 minutes of entry to confirm that their entry has been successfully received. Entrants will not be charged for receiving the confirmation SMS. From time to time, this may take longer due to operator traffic which is beyond the Promoter’s control.
    6. The Promoter, the Supplier and its associated partners (including without limitation FremantleMedia Limited and Syco Entertainment Limited) will not accept:
      • (a) responsibility for prize draw entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
      • (b) proof of transmission as proof of receipt of entry to the prize draw.
    7. By submitting a prize draw entry, you are agreeing to be bound by these terms and conditions.
  3. ELIGIBILITY
    1. The prize draw is open to residents of the Republic of Ireland aged 18 years or over except:
      • (a) employees of the Supplier, Zinmobi, the Promoter or their holding or subsidiary companies,
      • (b) employees of agents or suppliers of the Promoter or the Supplier or any of their holding or subsidiary companies, who are professionally connected with the prize draw or its administration; or
      • (c) members of the immediate families or households of (a) and (b) above.
    2. In entering the prize draw, you confirm that you are eligible to do so and eligible to claim any prize you may win. The Promoter may require you to provide proof that you are eligible to enter the prize draw.
    3. The Promoter will not accept prize draw entries that are:
      • (a) automatically generated by computer;
      • (b) completed by third parties or in bulk;
      • (c) illegible, have been altered, reconstructed, forged or tampered with;
      • (d) incomplete
    4. There is a limit of one entry per customer per mobile number in the prize draw. Entries on behalf of another person will not be accepted and joint submissions are not allowed.
    5. The Promoter reserves the right to verify the winner. Should the Promoter have any reason to believe that there has been a breach of the entry requirements or these terms and conditions, including, but not limited to, any tampering with the entry process, the Promoter may at its sole discretion refuse to process a win claim and refuse to award the prize or withdraw prize entitlement and disqualify you from further participation in the promotion.
    6. The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of this prize draw. The Promoter’s decision is final and no correspondence will be entered into.
  4. THE PRIZE

    The prize is an X Factor Live Final Experience (“the Experience”) comprising of 2 X Factor Live Final tickets for Saturday 12th December 2015 at the SSE Arena, Wembley, London and the following travel and accommodation provided by Mesh Marketing:

    1. For the avoidance of doubt, the Experience is for the winner and their guest to fly in economy class from Dublin Airport to London Heathrow Airport and share a twin hotel room in a hotel of the Promoter’s choice on Saturday 12 December including 1 breakfast meal for the winner and their guest. The Experience does not include travel insurance, the cost of transfers to and from airports or stations, food and drink, any additional hotel expenses, spending money, tax or personal expenses of the winner and their one guest. Any other costs incurred in addition to those set out above and that are incidental to the fulfilment of the prize are the sole responsibility of the winner and their one guest.
    2. The date and time of the Event is outside the control of the Promoter and may be subject to change without notice.
    3. You will be responsible for ensuring that you and any person travelling with you for the Experience are available to travel and hold valid passports, any necessary visas and travel documents for the holiday in question on the dates specified.
    4. The winner may allocate their second ticket and relevant travel for the Experience to a child aged 8 or over so long as the winner accompanies them at all stages of the Experience and bears responsibility for them throughout the Experience.
    5. Winners do not have a right to request a cash alternative to any of the prizes.
    6. The Promoter and the Supplier reserves the right exercisable at any time in its sole discretion, to terminate, amend, extend this promotion or to provide alternative prizes of equal or greater value to the Experience and/or Prize. Prizes are awarded "as is" with no warranty or guarantee, either expressed or implied by the Promoter, the Supplier, FremantleMedia Limited, Syco Entertainment Limited or their associated companies. All prize details are at the Promoter’s and the Supplier’s sole discretion. Any costs and expenses associated with prize acceptance and use not specified herein as being provided are each winner’s sole responsibility, including any and all taxes.
    7. The prize is not negotiable or transferable.
  5. WINNER ANNOUNCEMENT
    1. The winner will be selected at random from all qualifying submitted entries on 9 November 2015.
    2. The Promoter will make all reasonable efforts to contact the winner within 7 days of the closing date using the email address or phone number provided in the prize draw entry. The Promoter will make 2 attempts to contact the winner. If the winner cannot be contacted, is not available, or has not claimed their prize within 3 days of the first attempted contact, the Promoter reserves the right to select another winner in their place. The Promoter will not amend any contact information once the prize draw entry form has been submitted.
    3. The decision of the Promoter and the Supplier will be final and no correspondence or discussion will be entered into.
    4. The X Factor Live Final tickets included in the Experiences are for Saturday 12 December 2015. If the winner is unable to attend on 12 December or travel from Dublin to London on 12 and 13 December, the Promoter reserves the right to pick another winner.
    5. The Promoter and the Supplier reserves the right to publish the names and counties of residence of the winner. The winners must, at the Promoter’s request, participate in all promotional activity (such as publicity and photography) surrounding the winning of the prizes, free of charge, and they consent to the Promoter using their names and images in promotional material for up to one year after the competition closes.
    6. A list of Winners will be available on www.finish.ie/xfactor as soon as practicable from 30 November to 31 December and you consent to the use of their names in this way.
    7. The X Factor Final tickets are intended for the named winner and the resale of tickets is strictly prohibited. The named winner must collect the tickets along with their guest and must show relevant ID matching the name on their e-confirmation.
    8. Once the tickets have been collected on the day of the event the winner is solely responsible for them. The Promoter will not accept liability for any loss, theft or damage to these tickets.
    9. Separate Audience terms and conditions from FremantleMedia Limited, Syco Entertainment Limited along with a venue ticket disclaimer will apply.
  6. CLAIMING THE PRIZE
    1. The winner will be notified by email, within seven (7) days of the closing date and given full details on how to claim their prize being made. The Promoter will make all reasonable endeavours to contact the winner of the prize. If the winner cannot be contacted by the Promoter within 3 days of the first attempted contact, the Promoter reserves the right to re-draw the prize.
    2. The winner of the Experience will receive an e-confirmation 5 days prior to the X Factor Live Final on 12 December. The Experience winner must attend the X Factor Live Final venue at a time allotted on 12th December to trade their e-confirmation for their tickets. Failure to do so will result in that winner’s tickets being forfeited.
    3. The prize may not be claimed by a third party on your behalf.
    4. Neither the Promoter nor the Supplier nor FremantleMedia Limited or Syco Entertainment Limited accepts any responsibility if you are not able to take up the prize.
  7. LIMITATION OF LIABILITY
    1. Insofar as is permitted by law, neither the Promoter nor the Supplier nor FremantleMedia Limited, Syco Entertainment Limited or their agents or distributors will in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, the Supplier, Freemantle Media Limited, Syco Entertainment Limited, or their agents or distributors or that of their employees. Your statutory rights are not affected.
    2. In the event of circumstances outside the reasonable control of the Promoter, or otherwise where fraud, abuse, and/or an error (human or computer) affects or could affect the proper operation of this promotion or the awarding of prizes, and only where circumstances make this unavoidable, the Promoter and the Supplier reserves the right to cancel or amend the promotion or these terms and conditions , at any stage, but will always endeavour to minimize the effect to participants in order to avoid undue disappointment.
    3. The winner and their guest shall be responsible for any damage to the hotel or other venues (including their contents) visited by the winner and their guest caused as a result of a deliberate or negligent act or omission of the winners or their guests.
  8. DATA PROTECTION AND PUBLICITY
    1. If you are the winner of the Experience, you agree that the Promoter may use your name, image and town or county of residence to announce the winner of this prize draw and for any other reasonable and related promotional purposes for up to a year of the Closing Time. By entering the prize draw, you agree that any personal information provided by you with the prize draw entry may be held and used by the Promoter or its agents and suppliers or associated partners including FremantleMedia Limited and Syco Entertainment Limited to administer the prize draw.
  9. GENERAL
    1. The winner will be bound by the terms imposed by any third parties providing services as part of the Promotion (including but not limited to the Promoter’s travel and accommodation partners).
    2. If any provision of these Terms and Conditions is judged to be invalid, illegal or unenforceable, this shall not affect or impact the continuation in full force and effect of the remainder of the provisions.
